What Happens When Your Registered Manager Resigns? CQC Process and Continuity Plan

A resignation becomes a regulatory risk when the provider treats it as an HR event. The priority is continuity of accountable management: notify correctly, stabilise the service, protect knowledge and start a realistic replacement process.

The first 48 hours

  1. Confirm the dates and role. Record notice, proposed last day, regulated activities and locations covered.
  2. Escalate to the nominated individual. Review current service risks, leadership capacity and registration conditions.
  3. Check the CQC change route. Use current guidance for changes to registered manager details and activity.
  4. Name interim leadership. Define operational authority, on-call cover, safeguarding and regulatory decision routes.
  5. Open a controlled handover. Do not wait for the final week.

The interim model

Continuity means preserving decisions, escalation and oversight, not simply keeping visits on the rota.

A deputy may lead daily operations while the nominated individual increases provider oversight. Consider external mentoring or consultancy if internal competence is thin, but keep legal accountability and decision authority clear.

Set a temporary review rhythm: daily operational huddle for immediate risks; weekly nominated-individual review of incidents, capacity and actions; monthly board-level review until the new manager is established.

Recruit for registration, not just availability

CQC's 2026 manager guidance emphasises relevant management experience, a complete work history with longer gaps explained, the appropriate enhanced DBS route and evidence of qualifications and competence. Check the live application requirements before making the timetable dependent on an incomplete candidate file.

  • Test knowledge of the regulated activity and current service risks.
  • Ask for an evidence-based first 90-day plan.
  • Verify references, work history and reasons for leaving.
  • Separate employment start date from CQC registration status.
  • Give the incoming manager protected time to verify the handover.

Can the agency operate without a registered manager?

The provider must remain compliant with its registration and ensure safe, effective management. Treat the vacancy as a live regulatory risk and obtain service-specific guidance where needed.

Does the replacement need a CQC application?

Yes. Internal appointment does not itself make the person a registered manager.

Can the deputy be interim manager?

They may provide interim leadership if competent and properly supported, but use accurate titles and define oversight while the formal position is resolved.
